Welcome to Rackside. These Terms of Service ("Terms") govern your access to and use of the Rackside website (www.rackside.co.za) and the purchase of any products from us. By placing an order or using this site, you confirm that you have read, understood, and agree to be bound by these Terms.

If you do not agree with any part of these Terms, please do not use this site or purchase our products.

1. About Us

Rackside is operated as a business based in South Africa. References to "Rackside," "we," "us," or "our" refer to this business. References to "you" or "customer" refer to any person accessing the site or purchasing a product.

2. Products and Intended Use

Rackside sells gym essentials and fitness-related products intended for general consumer use.

Product descriptions, images, specifications, colours, sizes, and other product information are provided to help customers make informed purchasing decisions. While we make reasonable efforts to ensure that product information is accurate and up to date, minor variations may occur between product images and the actual product received.

Our products should be used only for their intended purpose and in accordance with any instructions, warnings, or usage information provided with the product.

3. Orders, Pricing and Payment

All prices are listed in South African Rand (ZAR) and include VAT where applicable.

We reserve the right to correct pricing, availability, product description, or other errors on the website. If an order is placed at an incorrect price due to an obvious error, we may contact you to confirm whether you wish to proceed at the correct price or cancel the order and receive a full refund.

Orders are confirmed once payment has been successfully received through PayFast.

Placing an item in your cart does not reserve stock. An order is only considered confirmed once payment has been successfully processed and the order has been accepted by Rackside.

We reserve the right to cancel an order where a product is unavailable, incorrectly listed, or where there is a suspected fraudulent or unauthorised transaction. Where an order is cancelled after payment has been received, the applicable amount will be refunded.

4. Shipping and Delivery

We deliver orders within South Africa using Aramex.

Our standard delivery timeframe is 10–12 business days from order confirmation.

Delivery times are estimates and may vary depending on the destination, courier operations, public holidays, peak periods, weather, or other circumstances outside our reasonable control.

Once your order has been handed over to the courier, delivery is subject to the courier's delivery processes and schedules.

Customers are responsible for providing accurate and complete delivery information at checkout. Rackside cannot be held responsible for delays or failed deliveries caused by incorrect or incomplete delivery details provided by the customer.

5. Returns and Refunds

Returns and refunds are handled in accordance with our Return and Refund Policy.

If you believe that your order is defective, damaged, incorrect, or otherwise qualifies for a return or refund, please contact us using the details provided on our website.

Nothing in these Terms limits any rights you may have under the Consumer Protection Act 68 of 2008 or other applicable South African law.

6. Damaged, Incorrect or Missing Items

If your order arrives damaged, contains an incorrect item, or there is another issue with your delivery, please contact us as soon as reasonably possible.

Where appropriate, we may request photographs or other information to assess the issue and determine the appropriate resolution.

Depending on the circumstances, we may provide a replacement, refund, or other appropriate remedy in accordance with our Return and Refund Policy and applicable South African law.

7. Product Use and Safety

Customers are responsible for using Rackside products in accordance with their intended purpose and any instructions or warnings supplied with the product.

You must not intentionally misuse, modify, alter, or use a product in a manner that is inconsistent with its intended purpose or supplied instructions.

Rackside is not responsible for damage caused by misuse, improper use, unauthorised modification, neglect, or failure to follow product instructions, except where liability cannot lawfully be excluded under South African law.

8. Limitation of Liability

To the maximum extent permitted by South African law, Rackside, its owner, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from the use of our website or products.

Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited under South African law, including applicable rights and protections under the Consumer Protection Act 68 of 2008.

Where permitted by law, Rackside's liability relating to a particular product shall not exceed the purchase price actually paid for that product.

9. Indemnity

You agree to indemnify and hold harmless Rackside and its owner from third-party claims, losses, or damages arising from your misuse of a Rackside product, your violation of these Terms, or your unlawful use of the website or products, except to the extent that such liability cannot lawfully be excluded.

10. Intellectual Property

All content on this site — including the Rackside name, logo, product images, copy, photography, graphics, and design — is owned by Rackside or licensed to us.

You may not reproduce, copy, modify, distribute, publish, or use any of this content for commercial purposes without our prior written permission.

11. Privacy

Your personal information is handled in accordance with our Privacy Policy.

By using our website or placing an order, you acknowledge that your personal information may be collected and processed as necessary to provide our services, process payments, fulfil orders, arrange delivery, provide customer support, and comply with applicable law.
